NEW Condo Criminal Law: ARBITRATION OF DISPUTES (ARBITRAJE DE DISPUTAS)


These are other new features of the new Florida Condominium "Criminal" Law effective July 1st, 2017

Arbitration of DisputesThe Division (DBPR) may but is not required to employ arbitrators.
  • The Division may also certify attorneys who are not employed by the division to act as arbitrators and conduct the arbitration hearings provided in this chapter.
  • A person may only be certified by the division to act as an arbitrator if he or she has been a member in good standing of The Florida Bar for at least 5 years and has mediated or arbitrated at least 10 disputes involving condominiums in this state during the 3 years immediately preceding the date of application, mediated or arbitrated at least 30 disputes in any subject area in this state during the 3 years immediately preceding the date of application, or attained board certification in real estate law or condominium and planned development law from The Florida Bar.
  • Arbitrator certification is valid for 1 year.
  • An arbitrator who does not maintain the minimum qualifications for initial certification may not have his or her certification renewed.
  • The department may not enter into a legal services contract for an arbitration hearing under this chapter with an attorney who is not a certified arbitrator unless a certified arbitrator is not available within 50 miles of the dispute.
  • Upon determination by the division that a dispute exists and that the petition substantially meets the requirements of the arbitration statutes, and any other applicable rules, the division shall assign or enter into a contract with an arbitrator and serve a copy of the petition upon all respondents.
  • The arbitrator shall conduct a hearing within 30 days after being assigned or entering into a contract unless the petition is withdrawn or a continuance is granted for good cause shown.
  • The arbitration decision must be rendered within 30 days of the hearing.
  • The arbitrator’s failure to render a written decision within 30 days after the hearing may result in the cancellation of his or her arbitration certification.

• La División (DBPR) puede pero no está obligada a contratar árbitros (“arbitrators”) independientes.
• La División también puede certificar abogados que no sean empleados de la división para actuar como árbitros y conducir las audiencias de arbitraje proporcionadas en este capítulo.

Official Records
  • Bids for materials, equipment or services are now official records.
  • The renter of a unit has the right to inspect and copy the association’s bylaws and rules.
  • By July 1, 2018, an association with 150 or more units which does not manage timeshare units shall post digital copies of some of its official records on its website.

·        Las ofertas de materiales, equipos o servicios son ahora documentos oficiales.
·        El inquilino de una unidad tiene el derecho de inspeccionar y copiar los estatutos y las reglas de la asociación.
·        A más tardar el 1 de julio de 2018, una asociación con 150 o más unidades que no gestione unidades de multipropiedad debe publicar copias digitales de  los documentos oficiales en sus páginas en la web.

Starting July 1 2017,  if the Association fails to provide an owner access to records you will be able to call law enforcement and press charges for OBSTRUCTING JUSTICE and/or TAMPERING WITH EVIDENCE.

The following language has been added to Florida Statute 718.111 (1) d:

“Forgery of a ballot envelope or voting certificate used in a condominium association election is punishable as provided in s. 831.01, the theft or embezzlement of funds of a condominium association is punishable as provided in s. 812.014, and the destruction of or the refusal to allow inspection or copying of an official record of a condominium association that is accessible to unit owners within the time periods required by general law in furtherance of any crime is punishable as tampering with physical evidence as provided in s. 918.13 or as obstruction of justice as provided in chapter 843. An officer or director charged by information or indictment with a crime referenced in this paragraph must be removed from office, and the vacancy shall be filled as provided in s. 718.112(2)(d)2. until the end of the officer's or director's period of suspension or the end of his or her term of office, whichever occurs first. If a criminal charge is pending against the officer or director, he or she may not be appointed or elected to a position as an officer or a director of any association and may not have access to the official records of any association, except pursuant to a court order. However, if the charges are resolved without a finding of guilt, the officer or director must be reinstated for the remainder of his or her term of office, if any.”

We met with Adrian Gonzalez, candidate for Commissioner of Miami Beach Group III.  Elections will be November 7, 2017.

Adrian's main opponent is Michael Góngora, a lawyer with Becker and Poliokoff.

We have other major issues with Mr. Góngora and B&P.  However,  want to avoid to be sued AGAIN!

Adrian, 42 years old, is married and father of two boys.  He is a small business owner: David’s Cafecito on Alton Road.  He grew up in Miami Beach.

Adrian and his family have experienced personal tragedy and unfortunate business hardships in the past “Great Recession.”    He had to make tough decisions that impacted other people but that he thought were the best outcome for all at that time.

He is also a man of faith and we are sure that his has atoned for any shortcomings.

Adrian knows firsthand what is going on in condominiums and he will help us to stop condo abuse as well as to mitigate excessive short term rental.

New Organization to battle abuses against owners by corrupt board of directors, property managers, lawyers and banks.



On Saturday, June 3, 2017 ReformaFL and friends held a meeting to create a new non-profit entity to help Condo Owners.

This entity will  help condo owners  to navigate and to educate them on the Condo Act and the new features.

We will work with elected officials to help reorganize the DBPR and the staffing of its Miami-Dade’s office.

ReformaFL will continue its grassroots’ activities protesting any abuses against owners by corrupt board of directors, property managers, lawyers and banks.
