On this date, March 20, 2012, the law firm of McArdle & Perez, P.A. delivered a Petition for Arbitration and a Request For Expedited Determination of Jurisdiction, to the Division of Condominiums of the State of Florida, on behalf of 24 Unit Owners at the Pavilion.
The Arbitrator has been asked to require the Board of Directors of the Pavilion Association to repeal the Tenant Registration Procedure due to a violation of Section 15.17 of the Declaration of Condominium, and to declare the tenant background screening and processing fees to be in violation of Section 718.112(2)(i) of the Florida Statutes since the Association does not have approval rights with respect to leases.
Pending the ruling of the Arbitrator, the attorneys have also prepared a lawsuit against the Board Members that voted for the rule, and the Association. This lawsuit will be filed when appropriate.
